These Terms of Service govern purchases made through the Modspeaker online store.
Modspeaker is operated by Valentin Luger, a sole proprietor based in Austria.

2. SCOPE
These Terms apply to orders placed through our online store.
Mandatory consumer protection rights remain unaffected.
Where mandatory consumer protection provisions of the consumer’s country of residence apply, those provisions also remain unaffected.
3. USE OF THE ONLINE STORE
The website may only be used for lawful purposes.
Customers who have not reached the age required to enter into a legally binding purchase contract may only place an order with the consent of a parent or legal guardian where required by law.
You must not interfere with the security or proper functioning of the website or transmit viruses, malicious software or other harmful code.
4. PRODUCTS
Modspeaker sells consumer electronics and related products, including portable speakers.
We aim to describe and display our products as accurately as possible.
Minor differences in colour, packaging or appearance may occur due to display settings, production batches or packaging changes, provided that such differences do not materially affect the essential characteristics of the product.
5. PRICES AND PAYMENT
The applicable total price and any additional shipping charges or other costs will be displayed before you submit your order.
Available payment methods are displayed during checkout.
Payments may be processed by third-party payment providers.
Where payment information is entered directly through such providers, we do not receive or store your complete payment card details.
6. ORDERS
Submitting an order constitutes an offer to purchase the selected products.
We may refuse an order before acceptance where legally permitted, including in cases of unavailable products, suspected fraud or misuse, unsuccessful payment, obvious technical or pricing errors or materially incorrect order information.
If payment has already been collected for an order that is lawfully cancelled or not accepted, the relevant amount will be refunded.
Mandatory consumer rights remain unaffected.
7. SHIPPING AND DELIVERY
Available shipping methods, applicable shipping costs and estimated delivery information are displayed on our website or during checkout.
Delivery times may vary depending on destination, carrier, customs procedures and other logistical circumstances.
Mandatory statutory rights relating to delivery, delays and non-delivery remain unaffected.
8. RIGHT OF WITHDRAWAL
Consumers who have a statutory right of withdrawal may withdraw from eligible online purchases within the applicable statutory period.

9. STATUTORY WARRANTY
Products sold to consumers are covered by applicable statutory warranty rights.
These rights exist independently of the right of withdrawal.
Nothing in these Terms restricts or excludes mandatory statutory warranty rights.

Content owned by or licensed to us, including Modspeaker branding, original graphics, text, logos and website design, is protected by applicable intellectual property laws.
Third-party trademarks and other protected material remain the property of their respective owners.
No right to reproduce or commercially use protected Modspeaker content is granted without permission.
11. THIRD-PARTY SERVICES
Our store may use external providers for services such as hosting, payment processing, analytics and shipping.
External websites and services may be governed by their own terms and privacy policies.
12. LIABILITY
Our liability is governed by applicable statutory law.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
To the extent permitted by law, we are not responsible for damage caused solely by misuse of a product contrary to its intended use or provided instructions.
13. CHANGES TO THESE TERMS
We may update these Terms where necessary.
Changes do not retroactively modify contracts already concluded unless expressly agreed or legally permitted.
The version applicable when an order is placed applies to that order.
14. GOVERNING LAW
These Terms are governed by Austrian law.
For consumers, this choice of law does not deprive them of mandatory consumer protection provisions applicable under the law of their country of habitual residence where those provisions cannot legally be excluded.
